Legal Question in Criminal Law in Minnesota
charged with 5th deg poss. for something a renter left in my home police came they said my name was on warrant because I was homeowner after 17mos of delays during which I had to give weekly ua's. My attorney said prosc. case weak and our defense was as well he advised me to take plea .. original charge dismissed and I plead guilty to a bad ua.. ((1 bad - 42 good) . Here's the problem warrant was issued for me because of the bad ua. I was arrested and booked judge asked me if I wanted to appeal or admit guilt. I said I was guilty she changed bail from RPR -to $500. Now they want me to plead guilty 2 it again. Wasn't the $500 I had to pay my punishment ? Doesn't Double jeopardy protects against more than one punishment for the same offense and if they dismiss original charge - the reason I gave ua in first place - wouldn't that include the ua that stemmed from it. Also, If prosecution doesn't have case do I even have to present defense can I just rest with reasonable doubt. I live in MN

It's impossible to "plead to a dirty UA." Something else must be going on here. Call or email a lawyer directly.
Hello. Different parts of your description just are not making complete sense. I suggest you either have the attorney you hired explain all to you so that you understand what is going on, or else hire a well-experienced attorney so she can give you a formal 2nd legal opinion at this time.
