Legal Question in Criminal Law in Minnesota

Continuance for Dismissal on Public Record

I was charged with theft, but recived a continuance for dismissal at my hearing. Now, when possible employers do a background check, what will they see? Will they see the theft charge, or will they see nothing?

Re: Continuance for Dismissal is on Public Record, unless "expunged"

If they check the court's public records, they would see a log of events with dates, related to you and your case(s). You can go to the courthouse yourself, and look at these records, free. They should be able to see the the criminal charge, that it was continued for dismissal, and hopefully one day its ultimate dismissal.

Once dismissed, you would qualify under Minnesota Statutes Chapter 609A, for an "expungement" or sealing of your public records, related to the criminal charge resolved in your favor (dismissed). If you then sought and recieved an Expungment Order from the court, then served it upon the appropriate government agencies, this should make it difficult or impossible for employers to find it.
