Legal Question in Criminal Law in Minnesota

Is this crimanal or civil in mn?

My company did construction work for a customer the customer paid me with three differnt checks made out to my company but the last check my salesman had the customer make out the final check to him personaly and never recieved it. In the amount of over 4600.00 dollars witch he deposited to his personal account.

It could be both criminal and civil. I would definitely try and make a police report about the incident. However, it's sometimes difficult to get the interest of the police in a matter such as this. You could certainly sue the salesman in conciliation court for the money as well.

The answer depend on your contract with the sales person. Ofte, where there is a civil remedy available, prosecutors are reluctant to file charges and will require you to file your case as a civil lawsuit.
