Legal Question in Criminal Law in Minnesota
Criminal offense
I have been charged with possesion of a controlled substance and parafeniela. I just had my hearing and was reappointeded a court date for a speedy trial at the end of the month. The surcumstance that i had this drug was they found a trace of cocine in a little box underneith my bed when they serch my room after an emergency call for an overdose suicide attemppt. Since then i am clean and sober and am getting mental help. When i was admitted in the hospital they gave me a drug screen that showed noillegal substances in my body becasue I was already on my way to sober life. The depression just had gotten to me. My question is what kind of punishment am i looking at worst nd best case and what should i plead?

Re: Criminal offense
Thank you for your post.
First, let me say that your health is the most important thing and you should be sure to take care of your depression.
Second, the potential sentence depends on the level of the offense charged. However, a conviction even for a misdemeanor can have long lasting effects including making it difficult to find employment or to rebnt an apartment in the future. As a result, you should hire legal counsel and contest the charges.
Based on your post, it would seem that there may be a basis to challenge the search. In many instances a criminal conviction can be avoided with a Stay of Prosecution so long as you agree to abide by certain conditions that may include treatment for chemical dependency issues.
