criminal sex offences

i have been charged with crim sex on a at the time 4 y/o boy i am completly innocent the boy is my ex'es son and we have a son together back in 2000 my x and her mother teied to pull this same thing on hermothers x but the man was never charged my x was a minor at the time i need those recourds on that attempt they made back in 2000 how do i get them the officer i talked to involved with that investigation said i could not have access to those records because she was a minor at the time but it isvery important to my case that the jury see what kind of a monstor she really is there is alot at stake for me here im not worried about the jail sentance if im found guilty i wont be cause i have a good case i worried about my son and the relationship that will be forever lost with him please help

Unfortunately, false allegations of criminal sexual conduct against children are often within the context of failed relationship between the adults, where one is causing the child to make false claims in order to get revenge upon the other adult. The only way I know to get records like that is to have your lawyer subpoena them, or otherwise get a court order for their release. That is what I have always done for my clients.

I am terribly sorry to hear of your legal troubles. Any criminal sexual conduct offense is extremely serious. Even on a first offense, the presumptive sentence for a first degree offense exceeds twelve years in prison.

Where young children are involved, there is always an issue as to whether they are competent to testify and whether the interview techniques used were highly suggestive resulting in a tainting of the child's memory and potential testimony.

Such cases are extremely complicated and often require expert testimnony.
