Generally, however, if there is a custodial interrogation, the officer must provide the defendant with their Miranda warning. If the defendant elects to speak with the officer, the officer has no obligation to tell the truth in the interview and may use statements and tactics designed to elicit inculpatory evidence. The defendant may invoke their Miranda rights at any time and, at that point, the interview must be discontinued.
