Legal Question in Criminal Law in Minnesota
A defendant plead guilty in federal criminal court (U.S. Distrcit of MN) to one count of making false statements to the Social Security Administration (resulting in health care fraud charges). Following this hearing the federal prosecutor filed a sentencing memorandum. However, it appears the defendant's federal public defender has not filed a sentencing memorandum. Is filing such a memorandum optional for either party? Thanks.

Yes. There is no mandatory requirement for filing.
