second and first degree murder by a juvenile

What kind of sentence can typically be expected in such cases? How would it differ in cases involving a juvenile with second-degree murder?

Re: second and first degree murder by a juvenile

In such a case, in most cases, you can expect hte prosecutor to seek to try the juvenile as an adult given the serious nature of the charge/ As a result, they would be treated like any other defendant. WIth no criminal history, the presumptive sentence for second degre murder alone is 261 to 367 months. In other words, the low end is over 21 years.

You should hire an experienced attorney.

Re: second and first degree murder by a juvenile

Typically a juvenile charged with the crime of murder could be expected to be the subject of a motion by the prosecutor to certify as an adult, and then be treated the same as an adult in such a case. Therefore, one could look at the Minnesota Felony Sentencing Guidelines, as well as any applicable Mandatory Minimum sentencing provisions, and charging enhancement statutes. We would need more information to be able to say more than that.
