if arrested on the road, but you do not have the keys to th auto in the car, but another person has control of them and he is out of the car, can you still be charged

From your description of this case, it sounds like you have a very good argument that you were not in "physical control" of the vehicle. The merits of your case will also be affected by the officer's rendition of events, but this sounds like a great start to keeping this off your record. You need to retain an attorney on this one.
