Alas, you can expect a DWI. The end result differs somewhat depending upon the county in which you were arrested. In the counties in which I practice law, a .13 will not get you a reduction from the DWI charge.

If you live in the metro area, it might be a different story.

First of all, do not be worried about going to jail for this offense. You probably already guessed that, but I wanted to make sure you knew that. The typical penalty for your offense would be to have the DWI conviction entered on your criminal and driving record, be placed on probation for 1-2 years, perhaps do some community service depending on the county you're dealing with, pay a fine of $300-500, attend an alcohol assessment and some educational classes, and have your license revoked for 90 days. The most difficult things to deal with on a first offense is that your record will now have alcohol on it and your license revocation will keep you from driving for at least a little while before you can get a work permit. There may be some ways to keep this off your record and to reduce or postpone the license revocation depending on your situation. You should speak with a couple of DWI lawyers before deciding what to do.
