DWI/Wreckless driving
How long does the state have, to refile a DWI & wreckless driving (there was an accident, only his car)charges. My son's case went to trial because he wasn't the driver but it was his car. The driver claims to not remember who was driving or what happened. The only proof the state has is the fact it is my sons car. The jury came back a mistrail because the jury was hung?Thank you

The statute of limitations spans a minimum of two years from the date of the offense. It would seem that without additional evidence, the state may decide not to proceed further.
