Legal Question in Criminal Law in Minnesota
Expungement
I was arrested for felony theft when I was 18, from my employer at the time. When it went to trial I was approved to go through what was called some sort of diversion program. If I went through it without trouble the conviction would be erased from my record.
My questions are:
(1) Can I have the arrest expunged?
(2) Is there a compleling reason to do so? I'm 41 and haven't had anything more than a traffic ticket since, have kids, married, etc...

With a diversion program, in most instances, the proecution is stayed until such a time as you complete all conditions of probation. If you successfully complete all conditions, the charge is dismissed. It is not erased.
Once the charge is dismissed, you may seek a statutory expungement which results in a sealing of all records judicial and administrative from all persons other than, potentially, law enforcement. An expungement is essentially a civil lawsuit to seal those records.
