Expungement of Record
I would like to know how to go about having my record expunged in the state of Minnesota. I was charged originally with 4th degree Gross Misdemeanor Sex Conduct and some how it got upgraded to 3rd degree Sex Conduct. I have not had any other occurrence in this matter, just basically traffic voilations. I have served all of my time and then some. The state that I reside in has made me register as a sex offender and the state that I was convicted in did not even make me require. I have been an upstanding citizen for the last 14 years since I was convicted and I would like my record expunged.

Expungements are very rare. There are two types of expungement. One is a statutory expungement. A statutory expungement is only aailable to seal an arrest record or court record if the case was resolved in your favor. In other words, you must have been acquitted or the charges were dismissed.
A second type of expungement is a judicial expungement. This is discretionary and rarely granted. moreover, it seals only court records, but does not seal administrative records such as those maintained by a police department or the Bureau of criminal apprehension.
The unfortunate fact is that it is extremely unlikely that you would convince a Judge to grant an expungement to a criminal sexual conduct charge.
