Legal Question in Criminal Law in Minnesota
Felony Burglary and Felony Theft in the Second Degree
I was in a way tricked in to driving to a house and having to other guys steel from the garage with out my knowlege.I let them put it in my car because I was not going to argue with them.I am the one who told the owner and the cops what had happen and it back fired at me, I thought I was doing the right thing. The reason the charged me is because the two guys said I had helped them and I was the mastermind behind it.I do not have any record at all, but the two other guys theft related convictions on there records. The oter thing is that I know the guy who got his stuff stolen and he is claming that there is $8000 of stuff stolen. The two guys admit they were out there twice, and they say I was the driver for both times.I told the cops I was out there one time and that I did not know what they were up to untill they came back, and I never whent in to any building at all. I feel framed and set up, I think those guys are protecting someone else that was involved in the second time that they went out there. I never had any of the stuff at my house at all. I am just woundering how do they convict someone on something like this when they dont have any proof that I did anything wrong.

Re: Felony Burglary and Felony Theft in the Second Degree
If a person admits committing a crime, that admission is a kind of proof. Normally, confessions need to be corroborated by some other evidence. In this situation, the confession(s) plus the co-conspirator (co-defendant) statements might be enough for a conviction at trial. If you knew that the other two men with you were stealing, and you helped them, then you could be found guilty of a crime. You would be well advised to consult a criminal defense lawyer soon, to discuss the situation and your defense options.
