Legal Question in Criminal Law in Minnesota

does my felony charge carry over?

In August of 2003 I was charged with felony check forgery. I pled

guilty, this was when I was 16 years old. I ended up getting a

probation violation and now have a warrant for my arrest. I will be

turning 18 in December. Does my warrant carry over after I turn

18? Will it ever go away? and what would happen if it carried over

past 18 years of age, wolud it be handled as a juvenile or an

adult? I would appreciate it if you could help me out with the

answer to my problems.

Thanks

The warrant will not disappear and will carry over. You must address the probation violation and the warrant or risk being arrested if you are ever stopped.

Re: does my juvenile felony adjudication & probation continue past age 18?

If you pled guilty to felony check forgery at age 16 in Minnesota, in all likelihood the juvenile court adjudicated you delinquent at that time. Minn. Stat. 260B.193, subd. 5(e) (2000), extends juvenile jurisdiction to

age 21 when a person who has already been adjudicated delinquent fails to appear at a juvenile court hearing or fails to appear at or absconds from a court-ordered placement.
