felony scratch off tickets

My 15 yr old daughter is getting charged with a felony because she there when he was working and he was scratching off lottery tickets and he won a 500 ticket. she was not with him when he cashed or had anything else to do with it. The police are stating she knew he wasnt paying for his tickets and he is 18 that was working there. This is her grandma gas station and she was hanging out? How can they charge her with felony and aiding the theft? He always told her he paid for his stuff after his shift was done? How is she laible she is a minor. He also let her purchase 5$ of lottery tickets. Shouldnt this fall on him?Another questions the camera in the gas station has audio,isnt audio without a warrant against the law?

being charged and being able to prove the charge are two separate issues altogether. Without some evidence of "intent" to commit a criminal offense, the case will likely fail. That can be challenged at, what is called, an omnibus hearing which occurs prior to ant trial.

Nonetheless, a felony is a very serious criminal charge and it should be answered with an aggressive derfense.
