Legal Question in Criminal Law in Minnesota
Felony Theft - Financial implications to spouse
I am currently awaiting subpeona for a felony theft case in which I admited to stealing and selling equipment from my employer. It is my understanding that there will be no trial as I have confessed to all of my illegal activites. My wife is now concerned about the financial ramifications. She is concerned about the financial well being and future of our two daughters. She believes that getting divorce is the only way that she can be cleared of any fines, court ordered repayment / wage garnishment, etc., that may result from the civil case filed by the insurance company trying to recoup their funds from the employee theft. My question is this: as I acted alone in my stealing and not even my wife knew what I was doing, is there anyway she can be held accountable or financially responsible for anything pertaining to my crime?

Re: Felony Theft - Financial implications to spouse
Why would you be awaiting a subpoena? I believe you may mean you are awaiting charges which would likely come through the receipt of a "complaint."
Your spouse has no personal liability if she was not a oarty to the offense. However, if a plea is entered or if you are found guilty after trial, restitution of the proceds taken would be required. That would be your obligation.
If it is a Federal case, the state may seek to seize any assets that were purchased by the ill gotten proceeds.
