Re: my fiance had warrant out/ for not registering as sex offender
I'm not sure I fully understand the question, but understand it relates to sex offender registration. I presume the registered offender is being brought into court to revoke his probation for failure to register. If so, it does not make any difference whether the BCA may have had an address for the offender. Registration is required by the offender, and the registration must be updated in the event of a move -- and other probationary conditions must be complied with. There is not enough information here to provide a detailed answer. If the defendant qualifies for a public defender, he should apply. If not, my contact information is below.
Thank you for your question.
Re: my fiance had warrant out/ for not registering as sex offender
This is a very serious iissue. It is a felony level crime to register as a sexual offender. the law requires that an individual notify the law enforcement agency where he lives of the intended move no less than five days before it occurs. If convicted of the offense, there is presumptive prison time of one year and perhaps as much as three years.
You must have a lawyer to argue the issue and to indicate that you complied with the law or made substantial efforts to comply with the law. The courts are very unforgiving on this particular issue.
