Legal Question in Criminal Law in Minnesota

Flase Rape Acusations

My girlfriends 17-year-old daughter, Camiko, says that I raped her a year and a half ago and two months ago. I DID NOT! Charges are still pending investigations. All who know me know it is not at all like me. My girlfriend, Sandra knows it is not true. All that know Camiko know she is a lier and a thief based om many other incedences. Sandra's other children, like me a great deal. However the County Sherrif reccomended that I move out of the home, even tho Camiko is staying with her sister. I have moved out because Sandra is in fear of loosing her other children to Foster Care, even tho the kids wanted me to stay. The Sherrif also said I could still see Sandra, just not Camiko. Sandra and I still see each other 3 days a week and are very much in love.

If the family wants me to stay ..shouldn't I? Does it look bad for Sandra as a unfit parent if I stay? Does it appear she or I am admitting guilt to the rape charges if I move out? I am just trying to keep everyone calm and going with the flow. This situation is very stressful on us all.

MY QUESTION IS: should I move or not, and what are the implications of either action?

Thank you so much

Sincerly Bewildered.

Re: Flase Rape Acusations

Thank you for the post.

First, it is a mistake to ever meet with law enforcement and provide a statement. Generally, officers are not looking for exculpatory evidence. The charges are VERY serious. As a result, there is reason to worry. To protect yourself, hire counsel immediately and make NO STATEMENTS to anyone other than your lawyer about the allegations.

Allegations of criminal sexual conduct are extremely serious. On a first offense on a first degree case, teh presumptive (usual) sentence upon conviction is 12 years.
