What is the min. & max. penalty for attempting to cash a fake traveler check when you were unaware it was fake.

The charges, as well as any possible sentence, will depend on several factors, but will be largely controlled by the dollar amount involved. If there is more than one victim, or the total dollar amount involved is over $500, you could be facing felony charges that carry several years imprisonment if convicted.
There are a number of factors that the State must prove in theft-related cases, and one of these is intent. In order to be convicted of possession of a counterfeit check, the State must be able to prove that you either knew, or should have had reason to know, the check was counterfeit. There are also several factors that play a role in sentencing upon conviction.

The charge would depend on the value of the traveler's check. It is an offense to knowingly cash a traveler's check that is not yours. If the value was in excess of $1000, it could be charged as a felony offense.
If the value was under $500, it is likely a misdemeanor offense and punishavble by up to 90 days in jail and a $1000 fine.
