forgery

What would the crime be and the possible punishment if a family member (not a spouse)takes someone's check book and forges the checkbook owner's signature. The amount of the checks at this time including some bank fees is in excess on $1400. As far as I know this is a first time offense for the person.

Re: forgery

The relationship between the perpetrator and the victim of a forgery crime is of no legal importance. If a person signs another's name, with that person's permission and authority to do so, then this is not forgery.

Minnesota Statutes Sections 609.625 and 609.63 are "Aggravated Forgery" and "Forgery," respectively. Many factors are listed which affect the potential maximum penalty, one of which is the amount. Advise the person to seek a personal office consultation with a criminal defense lawyer, such as me.
