gross misdemeanor

I have been charged with a gross misdemeanor..what are the chances of me serving jail time...it is my first offense

A gross misdemeanor is punishable by up to 1 year in jail and a $3000 fine. It is a very serious offense and, as a result, the potential for jail time upon conviction is great. Many factors must be reviewed including reviewing the nature of the offense the particular facts surrounding the case, and whether or not any viable defenses can be made.

In most instances, the best chance of avoiding a conviction and/or jail would be to hire a lawyer and present a vigorous defense. If you do not present a defense, there is little incentive for a prosecutor to agree to a plea that excludes jail.

The answer would depend upon the facts and circumstances, which are not stated in the question. A "Gross misdemeanor" has a maximum one year jail term under Minnesota state law. Some crimes carry minimums, but you did not mention a specific charge.
