Whether a court will impose jail time, if you are convicted, depends on a number of factors.

First, it depends on whether you are an adult or a juvenile. Second, it depends on the facts of your case. These facts will be in the police reports. Third, it can depend on the recommendations of the prosecutor, the person writing the sentencing report and the police officers. It can also depend on your past involvement with law enforcement. Finally, it will depend on the sentencing judge. So there are too few facts presented to tell what will happen in your case if you are convicted.

It sounds like you are being charged with two offenses Fleeing a police officer on foot (609.487) and Underage Consumption (340A.703 & 340A.503). A misdemeanor is punishable by up to 90 days in jail and/or a $1,000 fine.

It may be possible for them to add additional charges to this case, such as obstruction of legal process. I would advise you to meet with an attorney to go through the specifics of your case. Feel free to give our office a call (612-217-0077) for a free consultation.
