Though the question is not specific enough, generally using another person's identity could be a criminal act, subject to criminal prosecution. Which crime could be charged may depend upon other facts. For example, if the purpose was to obtain money fraudently, the criminal charge could be theft, fraud, idtnity theft, etc.
