Legal Question in Criminal Law in Minnesota
Okay, I was under the influence one night, and I'm not entirely sure what had happened. I woke up the next day with a ticket for 5th Degree Assault, and 4th Degree Criminal Damage to Property. I am on probation. But the cops did not catch me that night as I must of ran home. I woke the next day as my mom was telling me cops came over looking for me, an gave me a ticket with the above charges.
I am unsure of the actions I took that night, an since I did not get caught by the police, I did not get a minor consumption. I am 17 years old.
I want to know if I have a fighting chance in court, since I'm unsure what I did that night.
If I do not have a fighting chance in court. I would like to know the punishments I will more then likely have to undergo.
1 Answer from Attorneys
Without significantly more information, it is impossible to assess the case, your risks and/or defenses. If you retain counsel, that attorney would acquire the necessary evidence including police reports, witness statements, photographs and other information that may assist in determining what defenses may apply. You may also be proactive and seek assessments for some of the root causes of the conduct including chemical dependency assessments.
