I have a felony charge that I was not convicted of and it keeps coming back to haunt me. How do I go about getting an inspongement done? Do I need a lawyer for this? Does it cost alot?

There are two types of expungement in Minnesota. There is a statutory expungement, one that is authorized by statute; and there is a judicial expungement based on the inherent authority of the court.

When there has been a determination in your favor (eg. no conviction), you likely qualify for a statutory expungement and may file a civil Petition to seal all records from anyone other than law enforcement. This is a rather involved process and would require a hearing. The process takes at least 60 days from the filing before a hearing can be held.

If you did not plead guilty, you would likely qualify for expungement relief under Minn Stat Ch 609A, a sealing of public records from public view. Although it is possible to attempt this without a lawyer, I have seen cases where people tried to do this, but either failed entirely, caused damage, or failed to get as much relief out of it that they could have. It is best to have a lawyer help get this done.

If you are in the Mankato area, it might make sense to get help from a lawyer in that area, for this matter.
