Legal Question in Criminal Law in Minnesota
I was just issued a citation for misdemeanor theft (shoplifting). I was curious as to what I should expect when I appear in court, if I should have an attorney present with me, the chances of having this knocked down to a petty misdemeanor, what I should say and do when I appear before a judge, and the potential consequences of having a misdemeanor or petty on my record. Due to the fact that you are being charged with a crime, it is important for you to have an attorney with you. A misdemeanor offense on your record can affect the rest of your life. Unfortunately in our society, having a misdemeanor on your record will result in you being labeled as a criminal. This will likely affect further education, housing, and employment. Because the offense being charged is a theft case, these charges are even more serious. Employers will often refuse to hire someone due to theft charges.
Because of that, it is important to do everything possible to protect yourself and your rights when faced with a theft charge. The ability to negotiate an agreement to get the case reduced or dismissed often depends on the individuals knowledge of the system, the facts of the case, and the law. Which is why an attorney is essential.
