Legal Question in Criminal Law in Minnesota
is it legal for someone to steal personal property and then use the contents against you in a criminal case? For example, and this is just and example, if I had a briefcase with a couple of naked pictures of my wife. Legal pictures which she allowed me to take. Then we are in the throws of a divorce, a nasty divorce. So she steals my briefcase then takes the naked pictures and gives them to the police. Can they legally charge me with trying to defame her character? Can the police charge me with this?

The issue that you raise has too many factual questions for a simple answer on LawGuru. If this is an actual case, you need to contact a criminal defense attorney to sort through the issues. It might be possible for someone to take something from you and give it to the police to use against you. But this all depends on circumstances. That's why you want an attorney in the first place.
