Legal Question in Criminal Law in Minnesota

I live in Hennepin County, Minnesota. My girlfriend was charged with 5th degree domestic assault, she also has a 5th degree assault charge from a year and a half ago on her record but is no longer on probation for that however I think she may be on probation for a misdemeanor shoplifting charge. Based on her criminal history what likely sentencing is she facing?

Although the information you provided is fairly limited, it appears that she would be facing a Gross Misdemeanor charge for the 5th degree domestic because the prior 5th degree assault may be used to enhance the charges under Minnesota Statute 609.02. Because of this, the possible sentence is up to a year in jail and a $3,000 fine.

Any negotiations with the State depend on the facts of the case as well as other factors, such as who the prosecutor is, who the judge is, what stage of the proceedings you're in, who your defense attorney is, ect.
