Mail Fraud?

I had a package sent to me via UPS, the sender addressed the package to my name but to a different unit number in the same building. The Management company released the package to the person living in that unit. The package came with a return postage paid box to ship back if defective. Since the person who picked up the package hasn't returned the package to the management company or mailed it back, I am wondering if this can be considered eithor mail fraud or theft?

Based upon this story, it could be theft. You could contact the person, or ask apartment management to contact the person, to ask for the package. If they refuse to return it, this would tend to show intent to take property that they now must know does not belong to them -- theft. At that point contact police to make a complaint and ask that the person be charged with a crime. (You could ask police this question now, as well.) Another option would be to sue them in court for money damages. If the package was insured, you could look into making a claim on that insurance policy.
