Legal Question in Criminal Law in Minnesota
Marijuana Question
Hi. Me and my friend went and bought two dime bags of weed, small amount. We didn't know some undercover police were watching and they pulled us over. They said they could seize my car and make is their property and give me a felony for that because they watched me buy the dope. Is this true? They didn't end up charging us with anything and when I asked if they were going to tell my parents (I'm a minor), they said no and even suggested I didn't tell my parents. That didn't seem right either.

Re: Marijuana Question
The State of Minnesota could seize your vehicle pursuant to forfeiture laws if the State can prove a connection between the drug buy and the vehicle. It is certainly possible for them to do that in this situation.
It is still a possibility that the State charges you and your friend with a drug possession crime. It will all depend on whether the police write up reports and send them off to the county attorney's office.
The behavior by the police is a bit odd. Police do carry a level of discretion in the position as law enforcement. They may simply have felt scaring you and giving you a strong warning would be enough.
It is highly advisable that you not speak to law enforcement before speaking to an attorney. Also, no mention of this should be made to parents without speaking to an attorney as well. Anything said by you and/or your friend could be taken as an admission which could be used against you in court if you are ultimately charged with a crime.
Contact me if you have further questions. I would be happy to advise you.
Take care.
