Can you be ajudicated for a minor comsumption without being given a breathalyzer?

Yes. A breath-alcohol machine reading is only one type of evidence. Often, the suspect admits having consumed alcohol, which would normally be enough to convict in the most common circumstances. A lawyer may be able to help you avoid conviction or adjudicaiton.
