Misuse of financial aide from a state university
Is it illegal if a parent is given day care assistance based upon 3 children for a semester and only sends 2 children and keeps the money provided for the third child for herself?
The day care assistance was awarded by a state community college through their financial aide office.

There is not enough information here, to say much. The question hints at possible misrepresentation or fraud; or, possibly an unforeseen change in circumstances. One would have to look at the federal and-or state statutes and caselaw, as well as administrative rules; along with contracts, notices and correspondence -- for starters.
In general, for an act to be criminal, there must be intent to do the forbidden act -- minimally "knowledge." Civil laws (and civil liability) can also apply -- whether or not criminal laws do.
You may want to consult with a lawyer, by fully apprising the lawyer of all related circumstances, and have the lawyer look into it for you.
