Legal Question in Criminal Law in Minnesota
Second offense in theft
This occured in the State of Minnesota.
In early March 2006 I shoplift at a retail department store and was charged in July of 2006 with a Gross Misdemeanor in Theft. I served a few days in Jail when I was arrested, was on probation for 1 1/2 year, and did 40 hrs. of community service, and received an expungement in October of 2007. On Friday September 5, 2008 I shoplift at a retail store with an amount totaling $14.95. They cuffed me and took my picture and took my information down and mention that I will need to pay an amount of $50.00 due to Minnesota State statue of 604.14 within 30 days of the arrest. Also, advised that I will receive a letter for a court hearing and then allowed me to leave. I know what I did was very wrong and I am very miserable right now. I dont know what will happen. Please, would an attorney please advise what can happen in the court hearing. Would there be jail time, and if so how long? I really dont want to lose my job. I just have too much to lose right now.. Please, someone help me..

Re: Second offense in theft
It is difficult to say what will happen, though conviction and jail time would certainly be a possibility. Generally my focus is upon the outcome desired and planning a strategy to achieve that outcome. Call me if you would like to discuss representation.
