Legal Question in Criminal Law in Minnesota

open bottle

I was ticketed with an open bottle

passenger ticket. It wasnt my bottle

and i even told the officers it wasnt

mine there was 4 other kids in the

car and he was going to give it to the

driver so I took it instead for him but

I never confessed to the bottle being

mine after telling them to give me

the ticket they asked if it was my

bottle and I told them no and there

was no evidence to the bottle being

mine considering two other kids blew

numbers and got minors and i myself

blew zeros and the bottle was

nowhere near my spot in the car and

they still gave it to me. Also i have no

record and have never gotten even

as much as a speeding ticket. Will i

be able to reverse this and get it off

my record?

Re: open bottle

If you go to court and fight it, and refuse to plead guilty, you could keep your record clean of a guilty plea and conviction. Ask for an outcome without a plea. Be willing to pay.

Re: open bottle

A stay of Prosecution would not be an unusual resolution to such a case. With a Stay of Prosecution, the charge will stay off your record. However, you may be required to pay some prosecution costs.

You could certainly benefit from the assistance of counsel in such a matter. For a consultation call 612.240.8005.
