Legal Question in Criminal Law in Minnesota
pending charges
My boyfriend is being charged with aiding and abeding second degree murder but his lawyer was had put in a notion to dismiss the charges due to lack of evidence so i was wondering how long would that take because it's been almost 7 months since then and still hasn't been sentenced yet...and i just feel like his lawyer isn't doing much

Certainly a trial cannot proceed until the issue of probable cause has been decided. That is apparently the Motion that was filed. Until there is a ruling on that issue, the case remains in a holding pattern.
Certainly, any person chharged may demand a speedy trial. However, in many casees, there is no benefit to the request since memories fade and witnesses may become unavailable over the passage of time.
