Legal Question in Criminal Law in Minnesota
if a person has a stayed sentence and the courts have filed for a probation violation and it says stay of execution abolished what does that mean
3 Answers from Attorneys
It means they are seeking to execute the stayed sentence - in other words sentence the person to jail or prison time.
When a stay is vacated, then the sentence is executed, and the defendant goes to jail or prison.
I suggest that if you are facing this situation it is wise to confer with an experienced attorney. If you are represented by an attorney you may also obtain a 'second opinion' from another attorney. I suggest you phone several attorneys to choose who you want to help you, because an attorney is performing personal service work for you and it is keenly important that you feel a sense of great trust with the attorney assisting you.
