Legal Question in Criminal Law in Minnesota
I plead guilty to a Felony theft a few years ago with part of the plea agreement stating that after the probation period the conviction would be lowered to a gross misdemeanor. The probation period has come and gone with no issues, how long will it take for the conviction record to reflect the lower conviction? Will I ever be able to get this removed from my record all together? I am interested in working as a chemical dependency counselor and am concerned how this will affect that.

The court administrator's office usually gets around to deeming these misdemeanors within about six months. You can call the court administrator's office and nicely ask if they can do yours sooner. Regarding removing it from your record all together, you should consult with a lawyer about a possible expungement. There is a new statute taking effect on the first of the year that may be of some benefit to you. Feel free to call me for a free initial consultation.

You may make a request to court administration to make the change. As to your desire to work as a Chem' Dep' counselor, I urge you to confer with an experienced attorney as to the new 'Second Chance Law' which has been signed into law and takes effect on 1-1-15. Keep in mind that Chem' Dep' counselor training and licensing has some very detailed provisions as to those with past criminal records including felony level. All the best!
