Legal Question in Criminal Law in Minnesota
I plead guilty to 5th degree domestic assault under duress and shock. I have sentencing on the 17th, can I withdraw the plea?

Possibly. It is much easier to withdraw a guilty plea before sentencing versus after. You will have to convince the court that "it is fair and just to do so." If you don't have an attorney, you'll definitely want to retain an experienced attorney to help you with your plea withdrawal motion. The process is complicated. If you proceed on your own, I'm afraid that you probably won't be successful. Feel free to contact me to discuss further.

You may file a Motion to withdraw your plea. However, it is in the discretion of the Judge whether to allow you to do so. If you do withdraw your plea, you would face trial on the original charge. You should certainly retain counsel.

A motion may be made. I urge you to have attorney representation in this matter. Tricia Dwyer Esq at 612-296-9666, Tricia Dwyer Esq & Assoc PLLC, Minnesota Criminal Defense Attorney, Minnesota Domestic Assault - Protective Order Law, http://dwyerlawfirm.net
