Legal Question in Criminal Law in Minnesota
Can police search a home without permission and without a warrant? It happened this past week at our home. They just showed up at our front door and demanded to come in to search for someone who wasn't there. We told them they did not have permission but they pushed past us and searched in the house anyway. What rights do we have?
1 Answer from Attorneys
In certain circumstances a warrantless search of a home for a particular person by police is permissible pursuant to the United States Constitution. I suggest you google words such as 'warrantless search, 'exigency', 'hot pursuit' and examine the facts of your incident in light of law. You may secure a attorney at this time and discuss the facts should what occurred to you not seem reasonable. Tricia Dwyer Esq.
