It would be a good idea to retain counsel whenever you are a suspect in a criminal investigation. Often, it is not wise to submit to polygraph testing until you have exhausted other methods to avoid criminal charges. Even then, it may be a better idea to have a private test administered before submitting to one proposed by law enforcement.

You should certainly have an attorney discuss what questions will be asked to make sure they do not stray beyond the instant matter.

Ultimately, the test results cannot be used in a criminal trial. However, the results will affect how the prosecution proceeeds.

Your question is not clear. Generally, a criminal defense lawyer can retain a polygraph examiner to perform such an exam on a client, without having to disclose the result. Otherwise, it could be known or disclosed to law enforcement. It is a bad idea to submit to such an exam directly by law enforcement, since their reliability is less thn 100%.
