Questioning on Theft charges

I have been contacted by an investigator that wants me to come in and answer questions concerning a theft from my previous employer. I believe this would be a felony charge if I were to be charged. Should I go and talk to him or not? What will happen if I do or don't?

DO NOT make any statements to investigators or law enforcement. You have no obligation to do so and the only thing that they are seeking is inculpatory evidence to charge you. If they have sufficient evidence to charge you they will. Do not give them more.

If you have been contacted by an investigator it is possible, and maybe likely, they are investigating whether you may have any culpability. Whether or not you believe you have done anything wrong, under no circumstances should you speak to an investigator about this matter. You have no obligation to respond, and have no obligation to provide them with any information of any kind. No matter how innocent your statements may be, they can easily be corrupted and used against you. I would strongly suggest you promptly contact a lawyer about his matter.

If you did do anything wrong, and are being approached by an investigator for the company, you should be working with a lawyer in an attempt to resolve the matter and prevent a police report. If they make a report to the police and you are charged, it could be a felony charge, depending on the nature of the charge and the amount or value at issue. If that is the case, you would be wise to negotiate a settlement with them -- but only if it is done through a lawyer.
