Legal Question in Criminal Law in Minnesota

Registered sex offenders not allowed to move to MN ??

My husband was found guilty in MN nearly 10 years ago of an offense that required him to register as a sex offender. When we got engaged in January, 2002 we bought a house together in IA. However, he apparently didn't remembered to register in IA, for which he's already had to pay a fine, and serve probation. IA recently deemed constitutional a law stating he can no longer live in our home (everywhere in the COUNTY is off limits). We are only 7 miles from the MN border, so I suggested that he move to MN, rather than continue struggling to find any place in IA that he's permitted to live. I was then told by his probation officer that he has to be ''accepted by the state to live in MN.'' Is this true ? Can't he just move to MN and register there ? After all, he would be moving back to the state he was sentenced in, and had lived in for 6 years after.

I was told by our sheriff that if I provided a tax document from '02 showing our current home as his address, he could live here, but was told today that's not sufficient proof. That leaves him with just over a week to find a place to live, so your help is greatly appreciated. (As if it weren't bad enough that our children and I will be forced onto welfare because of this !)

Thanks.

If your husband is under supervision in Iowa his PO is correct. I do not have an opinion on why your husband failed to register as he was required to do.

I am not conversant with the provisions of Minnesota law governing the residency requirements for registered sex offenders. I suggest you employ the services of a Minnesota attorney to get to the bottom of this question.
