Legal Question in Criminal Law in Minnesota

I am the sole owner of a LLC in Minnesota - a subcontractor who had access to the business property left the premisis with LLC property he had no claim or ownership to. The theft was reported upon discovery. Now, however the county sheriff's department, after contacting the respondant who by phone only, falsly claimed to have ownership in the LLC, claims it is a civil matter and they will not attemt to recover the stolen property nor provide any protection of the remaining property of the LLC even when I offered to provide documentation that he has NO claim to anything. Minnesota staute 609.52 clearly defines theft and I do not understand the county attorney's claim that they can do nothing based on the respondant's false verbal claim.

Prosecutors will not file charges in many cases when there is an adequate remedy at law. Where two people claim ownership of property, it is generally considered a civil matter to be resolved by lawsuit.
