Legal Question in Criminal Law in Minnesota

My son is a bartender in minnesota and served 2 minors 8 months ago. He is just now being charged with this. Can they wait this long and what will the penalties be. It was his first and only time of doing this.

Yes. Though other potential defenses based on delay can be asserted, the shortest Minnesota statute of limitations period for crimes is three years.

The maximum penalty will depend upon the charge (look at the Complaint). The bigger problem will likely be whether he is convicted of a crime; whether he will have to live with a criminal record. He should retain a criminal lawyer and work to prevent that.
