Do I have to testify against my spouse?

Depending on the nature of the charge, yes you can be compelled to offer testimony against your spouse. I have had several cases in which a wife was compelled to testify against her husband, where she was the victim of an assault, and yet did not wish to testify. In fact, on one occasion, the wife was charged with criminal contempt because she refused to honor a subpoena. More facts are required to properly answer your question, however.

The answer depends on teh type of proceeding. In any criminal action where you or your child was not the victim, the answer is no. You have spousal immunity.
