Legal Question in Criminal Law in Minnesota

Stay of impostion

I was convicted of a felony 3 yrs ago. I was given a stay of imposition. I completed my probation period with flying colors. my probation ended on Jan 31 of this year. Can I know say that I have never been convicted of a felony or do I wait until I recieve the paperwork from the probation dept?

Re: Stay of impostion

Technically, you were convicted of a felony, although that felony was reduced after the probationary period. That would be the honest answer I am afraid.

Re: Stay of imposition

A felony charge, followed by successful completion of a stay of impositon of sentencing and expiration of probation, becomes a misdemeanor for most purposes (i.e. not civil rights to firearms, etc.) by operation of Minnesota Statutes Sec. 609.13, subd. 1 (2). After that, such a person could accurately say they were convicted of a misdemeanor, not a felony, on employment applications.
