Legal Question in Criminal Law in Minnesota

Tv mixup

I purchased a tv from cuircuit city and paid full price for it.When i went to pick it up the manager gave me the wrong one which was more expensive, and gave me a receipt for it. Circuit city is now calling me and asking if i can return the tv and get the tight one i was suppose to have. The manager was the one that told me this is the one you specially ordered which i did, technically. But if i don't return the tv is there something they can put against me. Because it was their mistake and he gave it to me with a receipt that i thought was mine

Re: Tv mixup

Even if there is an error, a failure to return the television and pick the correct set could result in a criminal charges. It is a theft offense to retain a product that was sent min error when the error is made known. A similar situation occurs when there is a bank error that provides an account holder with too mmuch money or where aan employer errs and provides an employee with a check in excess of earnings.
