Working with the prosecutor

Is there usually a way for your attorney to work out a deal with the prosecutor so that you wont have to serve jail time?

It depends upon the case and its facts and circumstances. It is important to determine a goal for a desired outcome, which seems either reasonable or necessary. Then work patiently and fearlessly to achieve that goal. That is the recipe for success.

In general, the more serious the crime, the worse the prior record, and the weaker the defense case, the more likely jail time could result.

There is no "usual" way to do so.

The answer depends on many things related to the particular circumstances of yoru case. There are many defenses to criminal charges. How well you assert those defenses may impact what plea deals are offerred.

Whether a plea agreement can be reached that involves no jail time or limited jail time would take into consideration many things including the nature of the offense, the potential defenses to the offense, and any past criminal record.
