Ambien = DUI
56 YO DH was charged with DUI. He took an Ambien, thinking he would be home before it took effect. He was wrong. Nicked another car, and slid into ditch. Arrested, blood taken. Released w/o bail next AM. Prev clean record. No alcohol use.
I want him to get atty. Is it reasonable to hope charges could be reduced or even dropped?

Every DUI case that does not involve alcohol is subject to challenge. Ambien is only a Schedule IV controlled substance, which means it isn't one of those big "NO NO" drugs to drive on. It would be a monumental mistake for your husband to plead guilty to this charge. And if his license is being revoked for the blood test result that should be challenged as well. Talk to an attorney who devotes the bulk of his/her time on DWI defense, like our firm does.

I hhad a similar cse recently where the charges were dismissed as part of a probable cause hearing. The defense in that case was two fold. The first is that the driving conduct was not impacted by the drug and the seccond, in that particular case, was an involuntary intoxication claim that was likely unique to the case.
